1. About these Terms

These Website Terms of Use ("Terms") apply to your use of the Melora Logistics website.

By accessing or using this website, you agree to comply with these Terms.

If you do not agree with these Terms, please do not use the website.

These Terms apply to use of the website only.

Freight services arranged by Melora may be subject to separate quotation, booking, service and freight terms.

2. About Melora Logistics

Melora Logistics Pty Ltd is an independent Australian freight brokerage that coordinates road and air freight services through transport and logistics partners.

Melora works with customers and transport providers to coordinate freight movements, communication, documentation and operational requirements.

We aim to provide clear communication, structured coordination and reliable freight management.

3. Website information

We endeavour to ensure that information on this website is accurate and current.

However, information on the website is provided for general information purposes and may change without notice.

Website content should not be interpreted as a guarantee that a particular service, carrier, route, price, transit time, capacity or delivery outcome will be available.

A freight quotation or booking confirmation will contain the specific details applicable to the relevant freight movement.

4. Freight quotations

Any freight pricing, transit times or service information displayed or communicated through the website is subject to confirmation.

A quotation may depend upon information including:

  • origin;
  • destination;
  • freight dimensions;
  • freight weight;
  • number of items;
  • freight type;
  • packaging;
  • access requirements;
  • delivery requirements;
  • timing;
  • carrier availability;
  • fuel or other applicable charges;
  • surcharges;
  • remote-area requirements;
  • dangerous goods requirements; and
  • other operational circumstances.

A quotation may be revised where material information changes or where information originally supplied by the customer is inaccurate or incomplete.

5. Freight bookings

A freight booking is not considered confirmed solely because an enquiry or quotation request has been submitted through the website.

A booking becomes confirmed when Melora has accepted the booking and communicated confirmation to the customer.

Additional terms may apply to individual freight movements.

6. Customer responsibility for information

Customers are responsible for providing accurate and complete information relevant to their freight.

This includes, where applicable:

  • accurate pickup and delivery addresses;
  • contact details;
  • freight dimensions;
  • freight weight;
  • number of packages;
  • description of goods;
  • value of goods;
  • packaging details;
  • access requirements;
  • delivery restrictions;
  • dangerous goods information;
  • special handling requirements.

Incorrect or incomplete information may result in additional charges, delays, rebooking, refusal of carriage or other consequences.

7. Packaging and preparation

Customers are responsible for ensuring that freight is appropriately packaged, labelled and prepared for transport unless Melora has expressly agreed to provide those services.

Freight must be packaged in a manner reasonably suitable for its nature, weight and method of transport.

Where freight requires specialised packaging, restraint, handling or preparation, the customer must notify Melora before booking.

8. Dangerous goods and prohibited freight

Customers must disclose any dangerous goods, hazardous materials, restricted goods or other items subject to special transport requirements before booking.

Customers must not tender prohibited or restricted goods without prior disclosure and approval.

Additional requirements, documentation, packaging, declarations, fees or carrier restrictions may apply.

Melora may refuse to arrange transport for freight that it reasonably considers unsafe, prohibited, improperly declared or unsuitable for the requested service.

9. Chain of Responsibility

Melora recognises the importance of Chain of Responsibility obligations under applicable heavy vehicle laws.

Customers must provide accurate information and cooperate with reasonable safety requirements relating to freight movements.

Customers must not request or require Melora, a carrier or another party in the transport chain to undertake an activity that would breach applicable transport safety laws.

Where relevant, customers may be required to provide information relating to:

  • freight weight;
  • dimensions;
  • loading;
  • unloading;
  • restraint;
  • delivery requirements;
  • access;
  • timing;
  • fatigue-related considerations; and
  • other safety matters.

Chain of Responsibility places safety responsibilities on multiple parties within the transport chain, not only the driver or carrier.

10. Carrier and transport partners

Melora may engage or coordinate independent transport providers, carriers, freight operators, warehouses, depots, airlines or other logistics providers to perform or support a freight movement.

Unless expressly agreed otherwise, Melora acts as a freight broker/coordinator and does not necessarily own or operate the vehicles, aircraft, warehouses or other transport infrastructure used to perform a service.

The terms and conditions of the relevant carrier or transport provider may also apply to the freight movement.

11. Transit times and delivery dates

Any transit time or delivery estimate provided by Melora is an estimate unless expressly agreed as a guaranteed service.

Transport can be affected by circumstances including:

  • traffic;
  • weather;
  • road closures;
  • vehicle breakdowns;
  • carrier capacity;
  • airport disruptions;
  • industrial action;
  • natural disasters;
  • accidents;
  • customs or regulatory requirements;
  • incorrect freight information;
  • loading or unloading delays;
  • restricted access;
  • recipient availability; and
  • other circumstances outside Melora's reasonable control.

We will endeavour to communicate material delays where we become aware of them.

12. Freight damage, loss and claims

Customers should notify Melora as soon as reasonably practicable if freight is:

  • lost;
  • damaged;
  • short delivered;
  • incorrectly delivered; or
  • otherwise affected during transport.

Claims may be subject to time limits, evidentiary requirements and the terms of the relevant carrier or transport provider.

Customers should retain relevant evidence including:

  • photographs;
  • delivery documentation;
  • consignment documentation;
  • packaging;
  • invoices;
  • purchase documentation; and
  • other evidence relating to the claim.

Nothing in these Terms is intended to exclude or restrict rights that cannot legally be excluded.

13. Insurance

Customers should consider whether appropriate freight or cargo insurance is required for their goods.

Unless expressly agreed in writing, Melora does not represent that a particular consignment is insured for its full replacement value.

Where insurance is requested or arranged, separate terms, limits, exclusions and conditions may apply.

14. Prices and additional charges

The agreed price for a freight movement may depend upon the information supplied by the customer.

Additional charges may arise where circumstances differ from those provided when the quotation was prepared.

Examples may include:

  • additional weight or dimensions;
  • inaccurate freight descriptions;
  • waiting time;
  • failed delivery;
  • redelivery;
  • storage;
  • additional handling;
  • difficult access;
  • tail-lift requirements;
  • residential or restricted-access delivery;
  • remote-area charges;
  • rebooking;
  • cancellation;
  • carrier surcharges;
  • dangerous goods requirements; or
  • other services requested after the original quotation.

Where reasonably practicable, Melora will advise the customer of material additional charges before they are incurred.

15. Payment

Unless otherwise agreed in writing:

  • invoices must be paid by the due date;
  • the customer remains responsible for charges associated with services arranged on its behalf;
  • disputed amounts should be raised promptly;
  • undisputed amounts remain payable.

Melora may suspend further services where an account is overdue, subject to applicable law and any contractual arrangements between the parties.

16. Cancellation

Cancellation fees may apply depending on:

  • when the cancellation occurs;
  • whether a carrier has already been engaged;
  • whether freight has been collected;
  • whether additional services have been arranged; and
  • the terms applicable to the relevant booking.

Any cancellation charges will be communicated to the customer where reasonably practicable.

This may include indirect or consequential loss, loss of data, loss of business, loss of opportunity or interruption arising from use of the website.

21. Indemnity

To the extent permitted by law, you agree to indemnify Melora against loss, damage, liability, cost or expense arising from your unlawful use of the website or your breach of these Terms.

This clause does not apply to the extent that the relevant loss was caused by Melora's own negligence, unlawful conduct or breach of a non-excludable legal obligation.

22. Privacy

Your use of this website is also subject to our Privacy Policy.

Our Privacy Policy explains how Melora collects, uses, stores and discloses personal information.
